This message is from the Victim/Witness Unit of the U.S. Attorney's Office in Portland, Oregon. We hope you will consider posting the following notice on your website, as a courtesy to all the victims in the Hoyt case.

The sentencing for Walter J. Hoyt, III, was originally set for April 30, 2001. It has been rescheduled, and is now set for June 19, 2001 at 9 a.m. before Judge Jones, at the U.S. Courthouse, 1000 S.W. Third Avenue, Portland, Oregon, in Courtroom 14A.  Because the date may change more than once, anyone wishing to attend should confirm the hearing date and time prior to making travel plans by calling the Clerk of Court, Criminal Section, at (503) 326-6384.

The U.S. Probation Office is currently gathering information from all identified victims for the Presentence Report to be reviewed by Judge Jones before sentencing, detailing the amount of victims' financial losses as a result of the crime. Victims are strongly encouraged to participate in this process so their losses can be included in calculating restitution orders and other recovery efforts.

Victims also have the right of allocution--the right to address the court and convey their point of view. Victims may make statements about the crime and its impact on their lives, or speak to or about the defendant, or make their wishes known regarding sentencing. Given the very large number of victims in this case, such statements to the court will need to be in writing, submitted for the judge's consideration prior to the sentencing hearing--rather than oral statements made at the hearing. The Victim/Witness Unit of the U.S. Attorney's Office would be happy to assist those victims who wish to make such statements to the court. 

We understand that the impact of fraud runs much deeper than just financial losses. It is a crime of betrayal that leaves victims at higher risk for developing serious health problems, difficulties in personal relationships, serious depression, and other harms. In this case particularly we know that issues with the IRS have been a source of secondary trauma, adding "insult to injury" for many victims.
